The NYS Senate and Assembly have once again passed legislation that would drastically expand damages awardable in wrongful death actions (S4423/A6063) Governor Hochul, who has vetoed all prior versions of this bill, now has until the end of the year to act on it.
This is the fourth year in a row that the legislature has passed wrongful death liability expansion legislation. If enacted, this legislation will vastly increase the amount of recoverable damages in wrongful death cases, placing significant strain on the state’s healthcare system which already struggles with recruiting and retaining physicians.
Hospitals and providers simply cannot absorb unprecedented cost increases that this legislation would cause while simultaneously facing the largest federal health care cuts in the nation’s history. We need your help to remind Governor Hochul that expanding awardable damages in wrongful death actions would further jeopardize access to care, accelerate provider shortages, and devastate New York’s healthcare system.
The New York State Radiological Society strongly opposes this measure and urges you to ask Governor Hochul to veto this legislation once again.
