Veto Wrongful Death Expansion

Your advocacy is needed! Ask Governor Hochul to Veto Wrongful Death Expansion!!!

Legislation that would drastically expand damages awardable in wrongful death actions has been transmitted to Governor Hochul (S8485B/A9232B). 

She must act on this bill before the holidays.

During the 2024 Legislative Session, the legislature passed wrongful death liability expansion legislation for a third time.  If enacted, this legislation will vastly increase the amount of recoverable damages in wrongful death cases. 

The difficulties New York State faces in retaining and recruiting physicians will be exacerbated by increased malpractice rates and threats of litigation. 

The Governor has vetoed previous versions of this legislation and must be reminded of the drastic effects expanding damages awardable in wrongful death actions would have on physicians, patients, and New York’s healthcare system as a whole.

The New York State Radiological Society strongly opposes this measure and urges you to ask Governor Hochul to veto this legislation once again.
